Less Restrictive WOTUS on the Way

The EPA and Army Corps of Engineers released Tuesday a redefined rule that rolls back the Obama administration’s Waters of the U.S.

The EPA says the new rule will help landowners know whether a project requires a federal permit “without spending tens of thousands of dollars on engineering and legal professionals.”

The rule also eliminates ephemeral streams and most ditches from federal jurisdiction as well as wetlands that aren’t “meaningfully connected to other jurisdictional waters.”
