Right to Farm Equals Right to Grow Pot?

A Missouri woman has used the right-to-farm amendment to the Missouri constitution to argue it is her right to grow marijuana in her basement.

The St. Louis Post-Dispatch reported recently that a 52-year-old Jefferson City woman was charged with a felony in 2013 in connection to the nine pot plants investigators found in her home in October 2012. Police said in court records the room was equipped with grow lights and a carbon dioxide generator, which enhances plant growth.

The woman initially denied knowledge of the plants and pleaded not guilty.

With the passage of Missouri’s right-to-farm amendment in 2014, her defense has changed. Her attorney today argues that the amendment protects Missouri citizens’ rights to engage in agricultural production and ranching practices.

A judge will consider the argument this month. S
